1. Introduction & Acceptance of Terms
By accessing or using HemailerPro (the “Service”), you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree with any part of the Terms, you must not use the Service. Your use of the Service after modifications to the Terms constitutes your acceptance of the revised Terms.
These Terms apply to all visitors, users, and others who access or use the Service.

3. Scope of Service & License Grant

4. User Responsibilities & Acceptable Use

5. Subscription, Billing & Payments

If you do not cancel before the end of the trial period (if offered), charges will apply.

All sales are final; we may offer refunds or credits only at our discretion.

6. Intellectual Property & Data Ownership

The Service, underlying software, source code, UI, designs, trademarks, and documentation remain the sole property of the Company.

You retain ownership of all Content you upload, submit or create using the Service.

By uploading Content, you grant the Company a worldwide, royalty-free license to store, process, and display your Content solely for delivering the Service.

You represent and warrant that: you own the Content (or have rights to use it); the Content does not infringe third-party rights; and its use by the Service will not violate any laws.
7. Data Protection & Privacy
We take data security seriously. We implement industry-standard security measures to protect your data. Still, you acknowledge that no internet transmission or storage is 100% secure, and you use the Service at your own risk. 8. Service Availability & No Warranty
While we aim to keep the Service available 24/7, we do not guarantee uninterrupted or error-free service. The Service is provided “as is” and “as available”. We disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law:

The Company (and its officers, employees, affiliates) will not be liable for any indirect, special, incidental, punitive, or consequential damages (lost profits, data loss, downtime, business interruption, etc.).

The Company’s total aggregate liability under these Terms will not exceed the amount paid by you in the 12 months preceding the claim.

These limitations apply even if we have been advised of potential damages or if a remedy fails of its essential purpose.
10. Term, Suspension & Termination

You may cancel your subscription at any time (per your plan’s terms).

Upon termination, your license ends, and you must stop using the Service. We may delete or archive your data after a certain period.

We may update these Terms at any time. When we do, we will post the revised version and update the “Last updated” date. Continued use after changes constitutes acceptance of the new Terms.

Failure to enforce any right or provision does not constitute a waiver of future enforcement.
